In the vast majority of cases, cover does not exist for business interruption claims arising from Coronavirus closure. This is a World crisis with much help coming from respective governments.
There are a small number of policies, with a small number of insurers, that potentially cover exposure to Covid-19 related claims due to ambiguous wordings. At present we are unaware that any of these insurers are accepting Business Interruption claims. Repudiation decisions are being challenged by policyholders and, in at least one Insurer’s case, an action group has been formed, which we expect will lead to litigation. If you have policies with any such insurers then whilst a repudiation of your claim is anticipated, you should log a claim so that you will have complied with policy notification conditions and not be debarred from a subsequent claim if any litigation process was found in favour of policy holders.
We continue to monitor a list of insurers and the wordings that may be challenged.
